One of the features of the Patient Protection and Affordable Care Act, the health-care reform bill colloquially known as Obamacare, is the creation of insurance exchanges that will offer heavily subsidized policies and coverage for people who cannot get insurance through their employers. In projecting the program's costs, the Congressional Budget Office figures that about 7 percent of the workforce currently covered by employer-provided insurance will drop those policies and sign up for the subsidized insurance. That estimate - and hence, the cost structure of the program - has been challenged by sources such as McKinsey & Company, the consulting firm, which reckons a far higher percentage of workers will opt out of their current job-based plans. In a survey of employers released in June, McKinsey found that 30 percent will "definitely or probably" drop their coverage as Obamacare kicks into high gear in 2014. Among "employers with a high awareness of reform, this proportion rises to more than 50 percent," says the report. Why? It will be cheaper to pay fines than to provide coverage. If those estimates are accurate, the cost savings ObamaCare supporters tout are a pipe dream. Glenn Morton, the author of the new book Passing Obamacare, has worked for nearly two decades in the health-insurance business, most recently as a broker who helps employers find better deals among providers. "If you're going to take away liberty and property, there has to be some sort of due process involved," says Chris Littleton, the head of Ohioans for Healthcare Freedom and a Tea Party leader in the Buckeye state. "In this case, as citizens, we feel that those things are fundamentally inhibited and we want the Supreme Court to hear our case on this." Littleton's group is pushing an upcoming ballot initiative that would amend the state constitution to prevent citizens' involuntary participation in any health-insurance system. The US Supreme Court is widely expected to issue a ruling on the constituationality of what's known as the "individual mandate" in Obamacare and Littelton thinks passage of the Ohio Healthcare Freedom Amendment will give his state unique legal standing: "This is citizen-initiated, which is very unique. If it passes, Ohio will be the only state that's done something like that." While most challenges to the individual mandate revolve around the limits of Congress' commerce clause powers, Littleton believes the amendment will activate due process and 10th Amendment considerations. The Patient Protection and Affordable Care Act (Obamacare) has set forth an individual mandate that requires all Americans to have health insurance. The justification for the law rests on the idea developed since the New Deal in the 1930s that any economic activity an individual engages in could impact the national economy and therefore can be regulated by the Federal Government based on its powers granted by the Commerce Clause in the Constitution. Up to this point, the Federal Government only regulated individuals if they actually engaged in economic activity. Now with the Individual Mandate, some in the Federal Government are arguing that because an American exists, that person could impact the economy and therefore can be regulated and ordered to purchase health care. The potential for such a policy to be abused is tremendous, and it leaves many wondering if Americans are truly free if their government can require them to buy something simply because they exist. Congresswoman Michele Bachmann went "On the Record" with Greta Van Susteren last night to explain how, unbeknownst to many Americans and members of Congress, $105 billion is already appropriated to funding ObamaCare through FY2019. Although the House voted in February to deny new funding for ObamaCare, it has done nothing to remove the $105464000000 that the last Congress allocated through passage of the Patient Protection and Affordable Care Act (ObamaCare). Unless Congress rescinds those appropriations, $5 billion will be spent this year and another $100 billion will be spent in the next 8 years (through FY2019). Specifically, Section 1311(a) of ObamaCare provides an unlimited appropriation to the Health and Human Services Secretary to award grants to states for Exchanges. Section 4002 essentially creates a $16 billion slush fund for the HHS Secretary to spend and $2 billion is appropriated to the Secretary per year in perpetuity after 2015. Section 4101(a) allows $230 million in appropriation for school-based health centers. Section 5508 appropriates $230 million for expanded primary care residency programs and Section 2953 allocates $320 to Title XX-type education programs.
