CHARLOTTE, NC - There are 300000 pending deportation cases in immigration court. The Obama administration now says many undocumented immigrants may not have to leave. That's pleasing some in our community, while others worry. And in the middle, law enforcement just wants to protect all residents. "Being a 15 year old, you know students aren't really looked at as anything but parties and having fun," said Debra Ortiz, a rising sophomore at North Mecklengburg High School. Instead of being like other teenagers, Ortiz spends her energy advocating for changes in immigration laws and policy. "Those baby steps and those little things may not be ideal," said Ortiz, "may not be exactly what we want, but it's a step in the right direction." Pleasing Ortiz in her cause, President Obama took a huge step by ordering the Department of Homeland Security to delay indefinitely many deportations. Mecklengburg County Commissioner Jim Pendergraph says he saw this coming. "Immigration enforcement has been sliding over the last many number of years and there just isn't any will power to enforce immigration laws." Over the weekend hundreds of activists who participated in the "Flytilla" to Israel were interrogated, refused entry, jailed, and are being deported in stages. === While the remaining boats in the Free Gaza Movement's flotilla are still trying to leave the Greek ports, activists from around the world organized a mass fly-in known as the Flytilla. Bowing to pressure from immigrant rights activists, the Obama administration said Thursday that it will halt deportation proceedings on a case-by-case basis against illegal immigrants who meet certain criteria, such as attending school, having family in the military or having primary responsible for other family members' care. The move marks a major step for President Obama, who for months has said he does not have broad categorical authority to halt deportations and said he must follow the laws as Congress has written them. But in letters to Congress on Thursday, Homeland Security SecretaryJanet Napolitano said she does have discretion to focus on "priorities" and that her department and the Justice Department will review all ongoing cases to see who meets the new criteria. The move is causing some alarm as it suggests the Philippines regards the Chinese regime as sovereign over Taiwan. On February 2nd, the Philippines extradited 14 Taiwanese nationals, along with 10 Mainland Chinese, over their suspected involvement in a fraud ring targeting Chinese nationals. The Obama administration publicly announced Monday that it has denied immigration rights to Bradford Wells and Anthony John Makk -- a gay couple in San Francisco that has been married for seven years -- and ordered the deportation of Makk to his native Australia, according to SFGate. Makk applied for permanent residency as a spouse of a US citizen when his visa expired, but he was denied, as his same-sex marriage is not federally recognized. Makk is the primary caregiver to Wells, who suffers from AIDS. The couple has lived together for 19 years and legally married in Massachusetts in 2004.

Josh Vandiver, a 30-year-old graduate student at Princeton University, and his husband, Henry Velandia, 28, a Venezuelan native, have waged a public battle to stay together. Although the couple were legally married in Connecticut last year, the federal Defense of Marriage Act prevents Vandiver, an American citizen, from sponsoring Velandia, a Princeton salsa instructor, for a green card. The 1996 law, known as DOMA, prohibits federal entities — including immigration courts — from recognizing a same-sex marriage for any legal purpose. For many gay and lesbian binational couples, the answer has been to emigrate to one of the few countries that recognize a gay spouse. Three years ago, Tom Smeraldo, 44, and Emilio Ojeda, 47, left their dream home in Washington Township in Warren County and moved to Toronto — a city they knew no one — because six years of fighting Ojeda's deportation had failed. But a shift in the federal government's policy on DOMA has offered hope to couples around the country. In February, Attorney General Eric Holder announced his department would no longer defend DOMA because it is unconstitutional.
