Par un arrêt du 19 novembre 2009, la Cour de Cassation vient de rappeler le prix qu'elle attache à la bonne exécution des obligations librement souscrites, et au soin que doit prendre l'entreprise à la formulation de ses offres commerciales. Au double visa des articles 1147 et 1148 du Code civil, la Haute Juridiction sanctionne l'inexécution dune obligation essentielle par Free, fournisseur daccès internet, alors même que l'exécution du contrat se trouvait empêchée par des circonstances qui lui étaient extérieures (son sous-traitant France Telecom en étant responsable). Le motif du défaut de fourniture du service à l'abonné ne peut recevoir la qualification de la force majeure : c'est-à-dire un événement imprévisible au moment de la conclusion du contrat, et irrésistible lors de son exécution. Cest ce que rappelle la Cour de Cassation dans cet arrêt important, qui souligne à la fois le caractère essentiel de l'obligation et sa qualification d'obligation de résultat, et relève que l'une des deux conditions de la force majeure n'est pas établie (les problèmes rencontrés n'étaient pas imprévisibles). Ainsi, si l'on soupçonne qu'un obstacle à l'exécution du contrat est possible, il ne suffit pas de s'entourer de précautions dans la rédaction du contrat, ni de prévoir conventionnellement l'exonération de responsabilité. Ce qui importe, c'est de ne pas promettre ce que l'on ne saurait tenir.

The key differences concern the following. Motivation: bank seeks to remove assets from balance sheet (balance sheet) or investors hire collateral manager to seek yield (arbitrage). The ceremony has become a tradition ever since the liberation of Har HaBayit (the Temple Mount) and the rest of the Old City of Jerusalem during the Six Day War in 1967. It is in commemoration of the Biblical obligation to visit the Holy Temple on the three annual festivals, namely, Pesach (Passover), Shavuot (Pentecost), and Sukkot (Tabernacles). It is also a special opportunity for many Cohanim (Jews who trace their lineage to Aaron, the first High Priest) to fulfill the Biblical obligation of blessing the nation, and for non-Cohanim to be blessed (also a Biblical obligation, according to some). It is to be noted that the Western Wall is merely a supportive wall of the Temple Mount in which the Holy Temple itself stood. The holiday prayers emphasize our goal of returning to the Mount, and not to the courtyards around it: "Bring us to Zion Your city with joy, and to Jerusalem, the House of Your Temple, with everlasting happiness... Build Your house as at the beginning, and establish Your Temple on its foundation; show us its construction and gladden us with its rectification... and to there we will ascend and be seen and bow down before You on our three festivals..."
